DUI DEFENSE IN CHARLESTON AND BERKELEY COUNTIES
If you are arrested and charged with DUI 1st in Charleston or Berkeley County, you will be given a ticket with an initial court date. If you refuse the test or provide a breath sample of .15% or greater, your license will be initially suspended for either one month or six months (one month for .15% or greater, six months for a refusal). You only have thirty days from the date of the arrest to request an administrative hearing challenging the license suspension. Some folks I speak with get confused by these two court cases going on at once. A person could lose the DUI case and win the implied consent hearing challenging their license suspension, lose the license hearing and win the DUI, or win or lose both. These cases are independent of one another. The DUI case is criminal and the implied consent case is administrative in nature. Both cases are very important however as both cary lasting consequences.
