SOUTH CAROLINA ROADBLOCKS

During the holiday and summer months, roadblocks are a common occurrence in South Carolina.  I represent people charged with traffic, criminal, and DUI offenses arising out of roadblocks.  The 4th Amendment to the U.S. Constitution requires all "seizures" to be reasonable.  A traffic stop is a seizure for purposes of the 4th Amendment.  Several United States Supreme Court cases have addressed roadblocks in the past twenty five years.  Law enforcement is allowed to conduct roadblocks that are closely tied to highway safety enforcement and all drivers should be treated the same.  The roadblock cannot be used as a subterfuge to fish for people who look like they might have drugs in the car.  Roadblocks can be used to enforce immigration laws as well.
