As of now, a little over 1/5th of the States criminalize refusing to provide a chemical test to determine blood alcohol concentration (South Carolina is not one of these). Specifically, refusing to provide a sample of one's breath, blood, or urine is charged as a separate offense other than DUI, DWI, OUI, and the like. On April 20, 2016 the United States Supreme Court will hear arguments in Bernard v. Minnesota where the Court will decide whether in the absence of a warrant, a State may make it a crime for one to refuse to submit to chemical testing for purposes of determining blood alcohol concentration.
