SC CRIMINAL DOMESTIC VIOLENCE & HUNTING/FIREARMS
Criminal Domestic Violence (CDV) is a crime in South Carolina. The law provides that It is unlawful to cause physical harm or injury to a person's own household member; or offer or attempt to cause physical harm or injury to a person's own household member under circumstances reasonably creating fear of imminent harm. The penalty for a CDV conviction first offense is 0-30 days in jail or $1,000 up to $2,000 in fines. CDV convictions carry a stiffer penalty than jail however. If you are convicted of a CDV charge, YOU ARE NOT ALLOWED TO POSSESS OR PURCHASE A FIREARM. It is a violation of Federal and State law to own or possess a firearm following a CDV conviction. The penalties for violating this provision are very severe.
I regularly represent folks charged with CDV. Most cases I am retained on involve arguments where law enforcement is called by one party. A common misconception is that CDV charges will be dropped if the spouse or victim "does not want to prosecute." This is generally inaccurate. The State makes the decision whether or not to prosecute.
